ArCohMARKETINGWhat we do, what you pay, who owns what we make, and what happens if something goes wrong. If a line here is unclear, ask us before you sign anything.

These terms apply whenever you ask us to help with your marketing — whether you found us through a phone call, a meeting booked on this website, or an introduction from someone else.
They are written in plain language on purpose. Where a formal client agreement is signed, that agreement takes priority over anything described here.
ArCoh Marketing is a Melbourne marketing agency based in South Melbourne VIC 3205. We work with Australian small and medium businesses, and with owners who want to know exactly what they are paying for.
The person you speak to is the person doing the work. There is no account manager between you and the person accountable for the result.
Our work generally covers one or more of the following:
Nothing on this website is an offer to supply a service. It is an outline of what we are able to do. What we will actually do for you is set out in a proposal.
The meeting is genuinely free. You bring the problem, we bring an honest view — including telling you when we are not the right people for the job.
A proposal sets out the work, the fee, and how long we expect it to take. It is open for 30 days unless we tell you otherwise; after that, prices and availability may change.
Work starts when you accept a proposal in writing. An email reply is enough.
If something comes up that sits outside what was agreed, we tell you before we do it, and agree the extra cost and time first. You will not see a charge you have not already been told about.
Our fees are set out in your proposal and invoiced as agreed there. Advertising budget — the money that goes to Google, Meta or any other platform — is separate from our fees, is paid by you, and is normally charged directly by the platform to your own payment method.
We do not take a cut of your ad spend, and we do not hold your advertising money. Anything that has to be bought for your project — stock imagery, a plugin, a licence, a domain renewal — is listed before it is spent.
Most delays come from the same few places, so we ask for this up front:
Ad, analytics and listing accounts — Google Ads, Google Analytics, Search Console, Meta Business Manager and the like — belong to you. Where we set them up, we set them up in your name and hand over full access when we finish.
We follow each platform’s own advertising policies. If a platform rejects an ad, limits an account or changes a rule, that decision is theirs and we cannot override it. We are not affiliated with, endorsed by, or acting on behalf of Google, Meta or any other platform.
Build work runs in stages: what was agreed, then a draft, then your feedback, then the finished version. Two rounds of changes are included unless your proposal says otherwise; larger changes are quoted before they happen.
If you stop a build part way through, we hand over what has been finished and paid for, including access to the files and any accounts in your name.
Once the invoice for the work is paid, the website, copy, creative and campaign assets you commissioned are yours.
We keep our own tools, templates, reporting setups and methods, and we can keep using what we learned doing the job. Third-party items — fonts, stock photographs, licensed software — stay under their own licences, which pass to you where the licence allows.
Dates in a proposal are our honest estimate, not a promise. If something is going to slip — on our side or yours — you hear about it before the deadline, not after it.
Anyone who promises a specific Google ranking, a fixed cost per lead, or a number of sales before they have looked at your market cannot honestly deliver it. We will not do that either.
What we commit to is doing the work properly, telling you what we are doing, and showing you the numbers behind it. We cannot control a search algorithm, an advertising auction, your competitors’ prices, or what your customers decide to do.
We will not advertise, promote or build anything that is unlawful, misleading or deceptive, that breaks Australian consumer law, or that a platform’s advertising policy forbids — including claims about health, finance, earnings or performance that cannot be evidenced.
If we find out a project involves something like this, we stop, and we tell you what we can and cannot do about it.
What you tell us stays with us. We do not pass your details, your numbers, or your plans to another client or a third party without your permission, and we ask before showing any of your material publicly.
Either side can end an engagement by telling the other in writing. Work done up to that point is invoiced, and anything prepaid but not yet used is credited or refunded.
Ending early does not cancel anything already owed, and it does not remove anything you have already agreed to pay for.
Our responsibility for a problem is limited to the fees you have paid us for the work that caused it. We are not responsible for lost profits, lost sales, or advertising budget spent through no fault of ours.
Nothing in these terms limits a liability that cannot lawfully be limited.
We only publish reviews that are genuine and written by someone who actually worked with us. We ask your permission before using your name, your business, or your results in a case study, and you can withdraw that permission at any time.
If you are not happy with the work, we would much rather hear it from you directly than read it somewhere else.
We handle personal information as described in our Privacy Policy. We may contact you about your project, and occasionally with something we think is useful to you. You can ask us to stop at any time.
Tell us first. Most problems are fixed with one phone call, and we would rather fix it than defend it.
If we cannot resolve it between us, you can raise a concern with Consumer Affairs Victoria or another external dispute resolution body. That does not stop you from taking a matter to court.
These terms are governed by the law of Victoria, Australia, and the parties submit to the jurisdiction of its courts.
We may update this page. The version published when your work starts is the version that applies to that work.
If anything here is unclear, say so before you sign anything. We would rather explain it now than argue about it later.
